A routine investigation of a two-car accident with no reported injuries turned into a felony arrest after one of the drivers failed a field sobriety test. The New London, Connecticut, driver, who was arrested for DUI, had a blood alcohol content that was allegedly in excess of three times the legal limit. A 5-year-old passenger was also in the vehicle.
According to the police, the 26-year-old woman crashed her car into another car that had stopped at a traffic light. Police at the scene suspected her of being under the influence and administered a field sobriety test, which she failed. She was arrested for drunk driving, risk of injury to a minor and following too closely.
The inability of the woman to pass the field sobriety test confirmed police suspicions about her physical condition. Later, a chemical test revealed her blood alcohol content to be over three times the legal limit of 0.08 percent, according to police.
Blood alcohol content levels are determined by the results of either a breath test or chemical test. Successfully challenging the accuracy of the tests and the validity of the results may not bring a dismissal of the charges. The prosecution may continue with evidence of intoxication based on the observations of the police officers of the accident, the condition of the suspect and her failure to perform the field sobriety test.
